Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Aethryva Deeptech Pvt Ltd ("Aethryva," "we," "us," or "our"), a company incorporated under the laws of India, operating the platform known as tachyDx, accessible at tachydx.com (the "Platform"). By creating an account, accessing, or using the Platform in any manner, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Platform.

1. Eligibility

The Platform is exclusively for licensed medical doctors and healthcare professionals who hold a valid and current medical degree from a recognized institution and are registered with a recognized medical regulatory body (such as the National Medical Commission, a State Medical Council, or an equivalent regulatory authority in their country of practice). By registering, you represent and warrant that you meet these eligibility requirements. You further represent that you are at least 18 years of age and have the legal capacity to enter into this agreement. We reserve the right to verify your credentials at any time and to suspend or terminate your account if your credentials are found to be invalid, expired, fraudulent, or misrepresented.

2. Account Registration and Security

You must provide accurate, complete, and current information during registration. You are solely responsible for maintaining the confidentiality of your account credentials. You must notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

3. Prohibited Content

You agree that you will not post, upload, share, or transmit any content that: contains protected health information (PHI), personally identifiable patient information, or any data that could reasonably be used to identify a specific patient; is defamatory, libelous, obscene, threatening, abusive, or harassing; infringes on any intellectual property rights, including copyrights, trademarks, or patents, of any third party; constitutes medical advice directed at a specific named individual or real patient case with identifiable details; contains malicious software, viruses, or any code designed to disrupt, damage, or limit the functionality of the Platform; promotes or facilitates illegal activity in any jurisdiction; impersonates any person or entity, or misrepresents your affiliation with any person or entity; or violates any applicable local, state, national, or international law or regulation.

All clinical questions, scenarios, and case discussions must be de-identified. You must remove or alter all identifying details, including names, dates, locations, medical record numbers, and any other information from which a patient could be identified, directly or indirectly. Violation of this requirement may result in immediate content removal, account suspension, or permanent ban, at our sole discretion.

4. Medical Disclaimer and Assumption of Risk

THE PLATFORM IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL JUDGMENT, DIAGNOSIS, OR TREATMENT.

All content on the Platform, including questions, answers, comments, published research papers, AI-generated summaries, citations, quality scores, and any other materials, represents the individual opinions and experiences of the contributing physicians. This content is provided for educational and informational purposes only. It does not constitute medical advice, a recommendation for treatment, or a standard of care.

You acknowledge and agree that: (a) clinical decisions must always be made by a qualified physician based on their own clinical judgment, direct patient assessment, and the specific circumstances of each case; (b) information on the Platform may be incomplete, outdated, inaccurate, or inapplicable to your specific clinical situation; (c) you assume full and sole responsibility for any clinical decisions you make, whether or not those decisions are informed by content found on the Platform; (d) Aethryva, its officers, directors, employees, agents, and affiliates bear no responsibility whatsoever for any patient outcomes, adverse events, injuries, deaths, or damages of any kind that result from the use, misuse, interpretation, or application of any information found on the Platform; and (e) published research papers on the Platform are generated through community discussion and AI processing and have not been reviewed by a formal editorial board, ethics committee, or institutional review board unless explicitly stated otherwise.

BY USING THIS PLATFORM, YOU EXPRESSLY ACKNOWLEDGE THAT YOU USE ALL PLATFORM CONTENT AT YOUR OWN RISK AND THAT AETHRYVA SHALL HAVE NO LIABILITY FOR ANY HARM, INJURY, DEATH, OR DAMAGE ARISING FROM YOUR RELIANCE ON ANY CONTENT ON THE PLATFORM.

5. User-Generated Content and Intellectual Property

By posting content to the Platform, including questions, answers, comments, clinical insights, and any other materials, you: (a) represent and warrant that you have the right to post such content and that it does not infringe the intellectual property or other rights of any third party; (b) grant Aethryva a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your content in connection with operating, promoting, and improving the Platform, including the generation and publication of research papers; (c) acknowledge that content published as part of a research paper on the Platform is released under Creative Commons Attribution 4.0 International (CC BY 4.0), which permits anyone to share, copy, redistribute, adapt, or build upon the material for any purpose, including commercial purposes, provided appropriate credit is given; and (d) understand that once content is published as part of a research paper, it becomes part of the permanent academic record and may not be fully retractable.

You retain ownership of the original content you post. However, the license granted to Aethryva survives termination of your account.

6. AI-Generated Content

The Platform uses artificial intelligence systems to: generate structured research papers from Q&A discussions, score content quality through the Publication Readiness Score (PRS), enrich answers with references and citations, and generate summaries and key takeaways. You acknowledge that AI-generated content may contain errors, inaccuracies, hallucinated references, incomplete information, or biased outputs. Aethryva does not guarantee the accuracy, completeness, or clinical validity of any AI-generated content. You are solely responsible for verifying the accuracy of all information, including AI-generated references and citations, before relying on it for any purpose.

7. Reputation System, Badges, and Rankings

The Platform maintains a reputation system that assigns points and badges based on user activity. Reputation scores, badges, and leaderboard rankings are calculated algorithmically and are provided for informational and gamification purposes only. They do not represent, imply, or constitute any endorsement, certification, or accreditation of clinical competence, expertise, or qualifications. Aethryva reserves the right to modify the reputation system, scoring criteria, badge requirements, and ranking algorithms at any time without prior notice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AETHRYVA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO: (A) YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM; (B) ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE PLATFORM, WHETHER BY USERS, AI SYSTEMS, OR THIRD PARTIES; (C) ANY CLINICAL DECISIONS, TREATMENTS, OR ACTIONS TAKEN OR NOT TAKEN BASED ON INFORMATION OBTAINED FROM THE PLATFORM; (D) ANY PATIENT OUTCOMES, INCLUDING INJURY OR DEATH; (E) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (F) ANY ERRORS, INACCURACIES, OR OMISSIONS IN ANY CONTENT; OR (G) ANY OTHER MATTER RELATING TO THE PLATFORM.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, AETHRYVA'S LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN NO EVENT SHALL AETHRYVA'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID TO AETHRYVA, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless Aethryva, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use of the Platform; your violation of these Terms; your violation of any applicable law or regulation; any content you post or submit through the Platform; your violation of any third party's rights, including intellectual property rights or privacy rights; or any clinical decisions, treatments, or actions taken by you or any third party based on content you posted on the Platform.

10. Content Moderation and Enforcement

We reserve the right, at our sole discretion, to remove, edit, or disable access to any content that violates these Terms or that we deem inappropriate, harmful, or objectionable for any reason. We may suspend or permanently terminate any account without prior notice and without liability to you. We are under no obligation to monitor all content posted on the Platform, and we make no guarantees regarding the timeliness of content moderation.

11. Availability and Modifications

We do not guarantee that the Platform will be available at all times or without interruption. We may modify, suspend, or discontinue any feature or aspect of the Platform at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

12. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is available at tachydx.com/privacy. By using the Platform, you consent to the data practices described in the Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India. You irrevocably waive any objection to the venue or jurisdiction of such courts.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

15. Waiver

The failure of Aethryva to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver shall be effective unless it is in writing and signed by an authorized representative of Aethryva.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Aethryva regarding your use of the Platform. They supersede all prior agreements, communications, and understandings, whether oral or written, relating to the subject matter herein.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Platform following the posting of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must discontinue use of the Platform and delete your account.
